The art. 1487 cc provides that “The contractors may increase or decrease the effects of the guarantee and may also agree that the seller is not subject to any guarantee”. This provision means that the contractors can freely agree on different warranty conditions and, in extreme cases, can even establish that no warranty is due. However, according to the Ermellini, a clause excluding or reducing the legal guarantee rights, however, should be expressly agreed upon and signed with a double signature pursuant to art. 1341 of the Civil Code, as it clearly and radically reduces the rights of the purchaser (Cass. 6011). However, there is a limit to the total exclusion of the guarantee: pursuant to paragraph 2 of art. 1487 cc “the seller is always liable for eviction arising from his own actions.
